If you own a flat and wish to rent it out as a holiday let, it is essential that you comply with all legal requirements. At HOMA, we guide you through every step to ensure the whole process is straightforward, transparent and secure. Below, we explain each stage of the registration process and the necessary documents in detail.

1. Obtaining a digital certificate

A digital certificate is essential for carrying out most online procedures and ensuring the authenticity of documents.

If you live in Spain: You can apply for it through the Spanish National Mint and have it validated at a local council office.

If you are abroad: You can complete the validation process via video call by following the instructions on the official website.

At HOMA, we can handle the application on your behalf and accompany you to Ayamonte Town Hall to obtain the certificate, as well as assist you with the installation process if necessary.

 

2. Holiday Accommodation Register (RTA number)

To rent out your property legally, you must register it with the Andalusian Tourism Registry and obtain an RTA number, which certifies it as a property for tourist use.

Required documentation
1. Property deeds

An official document certifying who the owner of the property is.
If the property has several owners, they must all be named in the title deeds.

2. Certification of the community’s articles of association

This is required if the property is part of a residents’ association. If it is not part of any residents’ association, you must still apply for it, although the outcome of the certification will be different.
This document confirms whether holiday rentals are permitted under the residents’ association’s rules.
It is obtained from the Land Registry.

If you require it, HOMA can handle this procedure for you, and the cost will be added to the total cost of HOMA’s administrative services

4. Special cases of joint ownership

If the property is jointly owned, each owner must have a digital certificate in order to sign the application.
If not all owners are able to obtain a digital certificate, a power of attorney agreement can be drawn up to allow one of them to handle the process. Ask HOMA about the various options available to guide you through the process.

 

How do I apply for a Tourism Registration?

Go to the Andalusian Regional Government’s website and follow these steps:

  • Complete the Affidavit online.
  • Please attach the required documentation.
  • Sign electronically using your digital certificate.
  • Submit the application and keep a copy of the submission confirmation.

 

At HOMA, we can assist you throughout the process, and if you wish, we can arrange an appointment at our office to help you complete the application. To do this, you will need to bring the laptop onto which you have downloaded the digital certificate. If this is not possible, please contact HOMA to discuss possible alternatives.

 

3. Application for the Single Register of Short-Term Leases

From 2025, it will be compulsory to register with the Single Register of Short-Term Lettings to ensure that holiday rentals are legal.

Documents required:
Tourism Registration Number (RTA).
CRU number: This is obtained using the property’s cadastral reference.
You can check whether your property has a CRU number on the Cadastral Register’s online portal.

If you do not have a CRU, you can request one by submitting a simple application to the Land Registry. At HOMA, we can handle this process for you, and the cost of this service will be added to HOMA’s administrative fee.

How to apply:

  • Visit the website of the Spanish Registrars.
  • Fill in the online form.
  • Please attach the necessary documentation.
  • Sign the application digitally.
  • Submit the application and keep the receipt.

 

4. Other regulations and procedures

To operate legally, in addition to registering, you must comply with the following regulations:

Civil Liability Insurance: Recommended to cover any potential incidents.
Local Regulations: Each local council may have additional requirements regarding safety and equipment.
